Artisan objects to the word "normally" in paragraph 2a. The policy as drafted does not provide any certainty needed to advise clients in respect of how to comply with this policy. There needs to be criteria within the policy to explain when 6 months marketing is sufficient and when it is not.
Further, how does one agree the marketing with the relevant LPA in way that complies with the policy? What criteria will the LPA be using to consider the duration of required marketing? This is why the criteria referred to above is important.
